1. Acceptance of Terms

By downloading, installing, or using Flight Path ("the App"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to these Terms, do not use the App. These Terms constitute a legally binding agreement between you and Ed Ward ("we", "us", "our"), the operator of Flight Path.

We reserve the right to update these Terms at any time. Material changes will be notified through the App. Continued use of the App after changes are published constitutes your acceptance of the updated Terms.

2. About the App

Flight Path is a training companion app designed for students undertaking the United Kingdom Private Pilot Licence (Aeroplane) — PPL(A) — qualification. The App provides structured support for the 19 exercises outlined in the CAA's CAP 1298 syllabus, including pre-lesson preparation tools, post-lesson debriefs, progress tracking, and AI-assisted learning aids.

Flight Path is intended solely for use by student pilots enrolled in, or preparing for, UK PPL(A) training. The App is designed to complement — not replace — formal flight instruction from a qualified instructor.

3. Account Registration

To use the App you must create an account using a valid email address. You are responsible for:

4. Subscription and Purchases

Flight Path offers a one-time Pro upgrade for £24.99, available via the Apple App Store. This is a lifetime, non-recurring purchase — there is no subscription fee.

The Pro purchase unlocks access to all 19 CAA exercises across the full CAP 1298 syllabus, including all preparation materials, AI-powered debrief, and progress features for every exercise.

All purchases are processed by Apple Inc. through the App Store and are subject to Apple's payment terms and Media Services Terms and Conditions. Refunds are governed by Apple's refund policy. We are unable to issue refunds directly — please contact Apple Support for refund requests.

Purchase status is verified via RevenueCat. If you restore a previous purchase on a new device, use Settings → Subscription → Restore Purchase within the App.

5. Free Tier

Without a Pro purchase, the App provides free access to your current exercise and the two exercises immediately before and after it in the CAP 1298 syllabus — five exercises in total. Your current exercise is set during onboarding and can be updated in your profile settings.

All previously completed lesson history and exercise records remain visible regardless of subscription status.

Flight Path is a training companion tool only. It is not a substitute for professional flight instruction, official CAA training materials, or the guidance of a qualified flying instructor.

All flight training must be conducted under the direct supervision of a suitably qualified flying instructor holding a valid CAA authorisation. All flying activities must comply fully with the UK Civil Aviation Authority (CAA) regulations, Air Navigation Order, Rules of the Air, and any other applicable legislation and airspace requirements.

Information provided within the App — including exercise briefs, tips, quiz questions, and weather data — is for educational and informational purposes only. It is not intended to be, and must not be treated as, authoritative operational guidance for flight. Always consult official CAA publications (AIP, NOTAMs, CAP documents) and your flight instructor for authoritative information.

We expressly disclaim any responsibility for decisions made or actions taken in an aircraft based on information obtained from this App.

8. AI-Generated Content

The App uses the Anthropic Claude API to generate post-lesson debrief feedback and to answer theory questions via the Ask AI Instructor feature. AI-generated responses are produced by a large language model and are intended for general educational guidance only.

AI-generated content must not be relied upon as authoritative, accurate, or complete aviation advice. It may contain errors or omissions. Always verify information with your flight instructor and official CAA materials before acting on it. We make no representations or warranties regarding the accuracy, completeness, or fitness for purpose of any AI-generated content.

9. Intellectual Property

The App, including all content, design, graphics, software, and materials within it, is owned by Ed Ward and protected by applicable UK and international intellectual property laws. Nothing in these Terms grants you any ownership or licence rights other than the limited right to use the App as described herein.

The CAP 1298 exercise syllabus structure is published by the UK Civil Aviation Authority. References to it within the App are for educational purposes.

10. Termination

We may suspend or terminate your access to the App at any time, with or without notice, if we believe you have violated these Terms or if we are required to do so by law. Upon termination, your right to use the App ceases immediately.

You may delete your account at any time via Settings → Delete Account. Account deletion is permanent and results in the removal of all associated data within 30 days, as described in our Privacy Policy.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Ed Ward shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including but not limited to loss of data, loss of revenue, or any loss arising from your reliance on information provided by the App — even if we have been advised of the possibility of such damages.

The App is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by English law.

12. Governing Law

These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of England and Wales. You and we both agree to submit to the exclusive jurisdiction of the courts of England and Wales.
